Successive deliveries of coloring agents to printing devices. Part 2
Part 2: includes the supply of coloring agents for printing devices in the quantities and minimum parameters specified in Annex No. 1 to the offer form (Annex No. 1 to the SWZ) and in Annex No. 1 to the Draft provisions of the contract for Part 2 of the procedure. Completion deadline - 12 months from the date of conclusion of the contract, with the proviso that in the event of exhaustion of the financial resources provided for its implementation, i.e. the gross value of the subject of the contract referred to in § 3 section 1 PPU, before the expiry of this period, the contract is automatically terminated on the day these funds are exhausted. The contract is also valid during the warranty period granted by the Contractor. Deliveries will be made successively, based on individual orders (Delivery Orders) placed by the Ordering Party. 1) The subject of the order is the supply of consumables for printing devices recommended by the device manufacturer. 2) Consumables must be recognizable by printing devices and do not cause negative messages to appear on the devices display or test pages, compatible with the equipment for which they were ordered, do not limit the functions and capabilities of the equipment and ensure full compatibility with the devices software. 3) During the operation of the supplied equivalent materials, no other message may appear in the monitoring and management software of the device and/or on the device to which a given consumable is installed, other than the one that will appear in the case of installing a functional, original consumable. 4) All materials offered for a given device model must come from the same material manufacturer. 5) The Ordering Party does not allow the offer of starter products. 6) In the case of consumables in which the manufacturer has included a region code, the Ordering Party expects the delivery of materials consistent with the region code dedicated to Poland. 7) With reference to Art. 101 section 4 of the Public Procurement Law, if the Ordering Party described the subject of the contract by reference to standards, European technical assessments, technical specifications and technical reference systems referred to in Art. 101 section 1 point 2 and section 3 of the Public Procurement Law, the Ordering Party allows solutions equivalent to those described. Furthermore, all such references should be deemed to be accompanied by the words or equivalent. 8) By original product, the Ordering Party means a product offered by a manufacturer of printing devices. 9) The term equivalent product means a product: • compatible with the device for which it was ordered, • with the same or better parameters (toner efficiency, print quality) in relation to the original produced by the device manufacturer, the number of copies/capacity cannot be lower than when using the originals; • if the original product has a built-in chip that monitors the printing process and ink/toner consumption, the equivalent product should have an analogous element. The Ordering Party will consider the product to be equivalent when the Contractor proves that the offered equivalent product has a toner/ink capacity and performance that is the same or better than the original product manufactured by the device manufacturer. If equivalent products are offered, the offer must include documents containing information on capacity and performance parameters that are the same or better than the original produced by the device manufacturer or licensed by it, in order to demonstrate their equivalence. The offered products should be brand new products. 10) The term factory new means products: a) made of new elements; b) are not regenerated, i.e. all product elements must be brand new; c) no signs of damage; d) in the manufacturers original packaging with a visible logo, product symbol and expiration date; e) have an individual toner code (type, model) on the packaging along with the name of the device for which they are intended. White packaging without the manufacturers logo, markings in the form of a sticker or products in packaging not from the manufacturer indicated in the offer is not allowed; f) they have an individual manufacturers code on the product enabling unambiguous identification and all security measures used by the manufacturer, e.g. holograms or identification stickers; g) no element of the product comes from a recycled process; h) having all tightness protection for toner tanks; (i) have not been subjected to a refilling process; j) do not cause damage to the devices in which they will be used; k) do not result in the loss of the device manufacturers warranty or the Ordering Partys loss of rights arising from service guarantees; l) do not limit the functions of idevice capabilities and print quality specified in the device manufacturers technical specifications.
