Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") constitute a binding legal agreement entered into between you (either as an individual bidder, corporate contractor, or institutional procurement entity, hereinafter "User" or "Subscriber") and TenderZenith (hereinafter "TenderZenith", "Platform", "We", or "Us").

By accessing, browsing, registering for an account, or purchasing any subscription on tenderzenith.com, you explicitly acknowledge that you have read, understood, and agreed to be legally bound by these Terms and our incorporated Privacy Policy.

While public tender notices originate from sovereign government entities and international multilateral development banks, the entire proprietary infrastructure of TenderZenith is protected under applicable intellectual property, database, and copyright laws.

Specifically, TenderZenith exclusively owns all proprietary rights, title, and interest in and to:

• Our custom procurement taxonomies, CPV code cross-indexing, and sector mapping schemas.
• Proprietary algorithms calculating AI Bid-Fit scoring, deadline estimation, and eligibility matching.
• Unified multilingual translation engines, curated metadata feeds, and cleansed document repositories.
• All front-end styling, typography, interactive dashboards, layout structures, and graphical assets.

Permitted Commercial Use: Subscriptions are granted solely to commercial enterprises, contractors, manufacturers, suppliers, and consultants who participate in public and commercial tenders directly or via consortium / joint venture arrangements. You are granted a limited, non-exclusive, non-transferable, revocable license to view, download, and analyze tender information strictly for your internal bidding evaluation.

Without prejudice to the generality of the foregoing, you explicitly covenant that you shall not:

Violation of this section constitutes a material breach under the Information Technology Act, 2000 and international copyright treaties, triggering immediate account termination without refund, IP blacklisting, and civil claim for statutory damages.

TenderZenith operates on a transparent, upfront billing structure. We provide extensive open access, including live search filtering, detailed tender previews, and sample qualification summaries to ensure every prospective subscriber can thoroughly inspect and evaluate our platform prior to purchase.

Policy Summary: Once payment has been completed and digital access provisioned, TenderZenith will not entertain any request for refund, fee reversal, chargeback, or cancellation under any circumstances. If you have any inquiries regarding subscription tier coverage or data availability for a specific country or sector, we advise you to contact our pre-sales advisory desk before executing payment.

Each TenderZenith user account and assigned subscription license is allocated to an individual corporate entity or specific authorized team members.

• Credential Confidentiality: You are solely responsible for preserving the confidentiality of your login passwords and API authorization keys. Any activity initiated under your authenticated session is deemed authorized by your organization.
• Prohibition on Account Sharing: Credentials may not be shared, pooled, or sub-licensed to individuals outside your corporate subscription tier or to unaffiliated third-party agencies.
• Concurrent Session Monitoring: TenderZenith employs automated security telemetry to detect anomalous, geographically disparate simultaneous logins. Accounts found engaging in credential sharing will be locked automatically.

TenderZenith aggregates hundreds of thousands of tender notices, expressions of interest (EOIs), requests for proposals (RFPs), corrigenda, and contract awards from sovereign government portals, municipal bodies, and international agencies across 112+ nations.

"As-Is" Provision: TenderZenith, its directors, employees, affiliates, and technology partners provide the platform on an "As-Is" and "As-Available" basis. While we strive for absolute completeness, we do not warrant that tender summaries, dates, estimates, or documents are error-free, uninterrupted, or comprehensive.

Limitation of Damages: Under no legal theory (whether in contract, tort, negligence, or strict liability) shall TenderZenith be liable to any user or third party for any lost profits, disqualified bids, lost tenders, operational downtime, or indirect, punitive, or consequential damages arising out of the use of or inability to use our intelligence services. Our aggregate liability for any direct claim shall be strictly capped at the amount paid by the Subscriber in the preceding three (3) months.

TenderZenith reserves the unilateral right to immediately suspend or permanently terminate any account, without prior notice or refund, upon the occurrence of:

• Any violation of our Anti-Scraping, Non-Redistribution, or Intellectual Property clauses.
• Unauthorized dissemination or commercial syndication of proprietary tender feeds.
• Chargeback disputes, non-payment, or disputed credit transactions initiated with payment gateways.
• Attempts to reverse-engineer, decompile, or compromise platform infrastructure security.

Governing Law: These Terms, their interpretation, validity, performance, and any non-contractual disputes arising out of or in connection with the TenderZenith platform shall be governed solely and exclusively by the Laws of the Republic of India.
