Contract Description

Purchase of the collection of Copernican monks Orest Pashkovych Acquisition of the entire collection of Orest Pashkovychs Copernican monks, included in the current detailed list
1. Subject of the order The subject of the order is the sale and delivery to the Ordering Party of the entire, complete museum collection of the Copernican monks Orest Paszkovych belonging to the Contractor, hereinafter referred to as the Collection, together with the documentation and rights specified in the draft contract. The subject is not defined by type. The Ordering Party purchases a specific existing Collection as an integral set with recognized history, structure and collecting provenance. 2. Material scope According to the inventory documentation, the Collection includes 6,836 objects in 17 subject groups, in particular coins, local and private issues, foreign coins, banknotes and securities, banknotes with prints, vouchers and cards, medals and plaques, badges, postcards, graphics, sculpture and small art, ceramics, pennants, packaging and other utility objects and Polish and foreign philately. A detailed list of the Collection constitutes Annex 1 to the draft agreement and indicates the subject matter as fully as possible. The rules regarding objects not explicitly mentioned but constituting part of the Collection, as well as the consequences of the lack of elements listed in the list, result directly from the draft contract and are not modified by OPZ. 3. Documentation of the Collection Together with the Collection, the Contractor provides all documentation related to the Collection within the scope provided for in the draft contract, in particular lists and annexes, catalogues, studies, photographic and audiovisual documentation as well as insurance and provenance documents, if they remain in his possession and can be effectively transferred. 4. Completeness, condition and authenticity. The Ordering Party shall accept the goods in the manner specified in the draft contract. In the event of any reservations regarding the condition, completeness or authenticity of the objects, the acceptance protocol is signed only after they have been clarified; if necessary, the Parties shall engage independent experts. OPZ does not limit the Ordering Partys rights provided for in the contract.5. Delivery and collection The Collection is released according to a protocol at the place indicated in the contract, after the required verification. The report should make it possible to record the number of units or teams transferred, the supporting documents, the result of the verification and any issues requiring clarification. 6. Integrity of the Collection and lack of an equivalent solution. The subject of the order is not the acquisition of any specific Copernican monasteries, but the acquisition of this specific, historically formed Collection as a whole. Its museum, scientific, documentary and exhibition value results not only from the value of individual objects, but also from their mutual context, collecting provenance, history of collection and maintaining the integrity of the group. The acquisition of other coins, medals, prints, graphics, philatelic objects or other Copernican objects - regardless of their individual value - would lead to the creation of a different collection and would not provide the same substantive, scientific and exhibition results. Replacing the Collection with other items would therefore change the subject and purpose of the order. 7. Price OPZ does not set the price and does not change the document estimating the value of the order. The sales price is the result of negotiations and is entered in the field provided for in the draft contract. Unit prices and historical values appearing in the listing materials are of a documentary and auxiliary nature. 8. Priority of the contract In the event of any discrepancy in interpretation between this OPZ and the draft or content of the concluded contract, the contract shall prevail with respect to the rights and obligations of the Parties. The OPZ serves to clarify the subject matter and not to change the contractual provisions.
