Contract Description
Port Esbjerg, the Municipal Self-Governing Port ("Port Esbjerg"), currently operates a four-line mobile harbour crane manufactured by Liebherr (type LHM 800) with a lifting capacity of 308 tonnes. As part of a port expansion project, Port Esbjerg requires the acquisition of a new mobile harbour crane. The new crane must, on a stand-alone basis, be capable of lifting 308 tonnes and, when operating in tandem with the existing crane, be capable of lifting 616 tonnes. This requires the new crane to be electronically interconnected with the existing Liebherr crane. Otherwise, in accordance with the applicable Danish Working Environment Authority guidance notice (No. 2.02.3), only 75% of the respective lifting capacities of the cranes may be utilized during tandem lifting operations. As only a Liebherr crane can be electronically interconnected with the existing Liebherr crane, technical and intellectual property-related considerations mean that only the incumbent supplier is capable of meeting Port Esbjerg's requirements. For a negotiated procedure without prior publication under the Utilities Directive, this wording is also suitable as the basis for the justification of the absence of competition for technical reasons.
