Proceedings for the award of public procurement for social services and other specific services in accordance with Art. 359 points 1, is conducted in an open tender pursuant to Art. 132 of the Act of September 11, 2019. – Public Procurement Law (consolidated text: Journal of Laws of 2024, item 1320), hereinafter referred to as the PZP Act, implementing acts to the Act, as well as in accordance with, among others, with: - Act of April 16, 1993 on combating unfair competition (consolidated text: Journal of Laws of 2022, item 1233, as amended) - Act of February 16, 2007 on competition and consumer protection (consolidated text: Journal of Laws of 2021, item 275). The Ordering Party in accordance with Art. 360 point 3, when awarding social contracts, there is no obligation to comply with minimum deadlines for submitting applications to participate in the procedure or deadlines for submitting offers. To the extent not regulated by this Specification of Order Conditions, hereinafter referred to as the ToS, the provisions of the Public Procurement Act shall apply. The provisions of the Act of April 23, 1964 - Civil Code (consolidated text: Journal of Laws of 2022, item as amended) will apply to the activities undertaken by the Ordering Party and the Contractor, unless the provisions of the Act provide otherwise. The subject of the order is the provision of catering services consisting in the preparation and delivery of food to patients of the Provincial Specialist Hospital. J. Gromkowski at ul. Koszarowa 5 in Wrocław (hereinafter referred to as the Hospital), in a tray system, including children from 5 months to 18 years of age, lunches and afternoon snacks for patients of the Daily Center for Psychiatry and Speech Disorders for Children and Adolescents at ul. Wołowska 9 (hereinafter referred to as the Centre), in the manner and under the conditions specified in the Description of the Subject of the Order, constituting Annex No. 1B to the SWZ. The expected quantities of the subject of the order are specified in Annex No. 1A Assortment and price form SWZ. A detailed description of the implementation of the subject of the order is included in Annex No. 1B and the Draft Agreement in Annex No. 5. The Ordering Party requests that the contractor indicate in the offer the parts of the order whose performance it intends to entrust to subcontractors and that the Contractor provide the names of the subcontractors companies - in accordance with Art. 462 section 2 of the Public Procurement Law, if they are already known. If the change or resignation from the subcontractor concerns the entity whose resources the contractor relied on, in accordance with the principles set out in Art. 118 section 1 of the Public Procurement Law, in order to demonstrate compliance with the conditions for participation in the procedure, the contractor is obliged to demonstrate to the ordering party that the proposed other subcontractor or contractor independently meets them to an extent no less than the subcontractor whose resources the contractor referred to during the contract award procedure. The provision of Art. 122 of the Public Procurement Law shall apply accordingly. Partial offers: The subject of the order constitutes one whole. The scope of services and the estimated value of the contract are the premises for the implementation of the subject of the contract to be addressed to small and medium-sized enterprises in accordance with the definitions contained in the Commission Recommendation of May 6, 2003 on the definition of micro, small and medium-sized enterprises (OJ EU L 124, 20/05/2003, p. 36). The lack of division into parts is also determined by the requirements of the overall implementation of the service and the need for proper coordination of all works. Employment under an employment contract: Pursuant to Article 95(1) of the Public Procurement Act, the Ordering Party requires the employment of persons responsible for the process of preparing and serving meals by the Contractor, subcontractor/subcontractors performing activities during the execution of the order under an employment contract (within the meaning of Article 22 § 1 of the Act of 26/06/1974, Labor Code (consolidated text: Journal of Laws of 2022, item 1510). as amended).) or similar provisions of EU and EEA Member States. During the execution of the order, the Ordering Party is entitled to carry out inspection activities towards the Contractor regarding the fulfillment by the Contractor or subcontractor of the requirement to employ persons performing activities under the order under an employment contract. The rules for documenting employment under an employment contract of persons performing activities as part of the execution of the contract in question, as well as the control of this obligation by the Ordering Party and the sanctions provided for in this respect are set out in the contract template, Annex No. 5 to the SWZ. With regard to the condition specified in Art. 96 section 2 point 2e of the Public Procurement Act regarding accessibility for disabled persons, referred to in Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement (Journal of Laws EU No. 94, p. 65), the Ordering Party informs that it has included in the description of the subject of the order the required features of the product and service, including adaptation to the needs of all users. - the rest of the provisions - in accordance with the SWZ. 11.4. On-site visit 1. The Ordering Party allows participation in an on-site visit during the tender procedure, in accordance with Art. 131 section 2 of the Public Procurement Law. Completing the inspection is not obligatory, and failure to do so does not result in rejection of the offerpursuant to art. 226 section 1 point 18) of the Public Procurement Law. 2. Due to technical reasons (active facility) and the specific nature of the kitchens work, and primarily due to the hygiene principles of food preparation and sanitary standards, the Ordering Party allows an inspection to be carried out on the day specified by the Ordering Party, i.e. March 7, 2025, between 9.30 a.m. and 10.00 a.m. 3. The cost of the on-site visit is borne by the Contractor. 4.
