Estimated value of the largest subsequent contract expected to be awarded during the framework agreement for Lot 2 = 1,500,000.00 lei without VAT Estimates of the minimum and maximum quantities that could be requested during the entire framework agreement: minimum quantities 1pc, maximum quantities 2pc. Estimated calendar (frequency and value of the contracts to be awarded): Based on the framework agreement, subsequent contracts may be awarded for any period covered by available budget, for each lot depending on the needs of the hospital and the allocated funds, economic operators being informed that they cannot impute to the hospital a possible non-execution of the contract in connection with the minimum / maximum quantities estimated for each lot. The minimum and maximum quantities of products to be delivered represent estimates of quantities that could be requested during the entire framework agreement, and not the exact quantities that will be purchased, the latter may be smaller or equal, compared to the estimated ones, depending on the actual needs of the contracting authority and the budget funds allocated for this purpose. In the event that the economic operator, the signatory of this framework agreement ranked 1st, does not have the capacity to fully respond to the request (impossibility of securing the entire requested quantity, non-compliance with the assumed conditions regarding quality, delivery term, price, validity, etc.), the contracting authority will send requests to the occupier of the 2nd place, and in case of denial/lack of response from him, to the occupier of the 3rd place (when the framework agreement is signed with 3 economic operators), following that the economic operator(s) ranked 1st, 2nd and/or 3rd must bear for the non-fulfillment of the obligations assumed in his/her responsibility, the provisions of art. 111 par. (2) and (3) of H.G. 395/2016, with subsequent amendments and additions.
