The subject of the order is: Purchase of 1 (one) set of TXRF total reflection X-ray fluorescence spectrometer (using multiple excitations) with equipment. A detailed description of the subject of the order and other information necessary to complete the order are included in Annex No. 1 to the SWZ Technical specification. The Ordering Partys requirements included in point 4.2. in connection with the provisions of Art. 118 and/or art. 462 of the Public Procurement Law: to the extent specified in the SWZ, they apply to entities on whose abilities or situation the Contractors will rely after making them available, in relation to the Ordering Partys reservation contained in point. 4/14. do not apply to: a) subcontractors who are entities providing resources to Contractors, b) subcontractors who are not entities providing resources to Contractors. The terms and conditions of payment and the terms of implementation of the subject of the contract are included in Annex No. 4 to the SWZ - Drafted provisions of the contract, containing the draft provisions of the public procurement contract that will be introduced into the public procurement contract. Description of the subject of the contract based on the Common Procurement Vocabulary (CPV): Code: 38433000-9 - Spectrometers The Ordering Party does not provide for the option right referred to in Art. 441 of the Public Procurement Law. The Ordering Party does not allow the submission of partial offers. The Ordering Party does not allow the possibility of submitting variant offers within the scope specified in Annex No. 1 to the SWZ Technical Specification. The Ordering Party does not envisage concluding a framework agreement. The Ordering Party does not specify employment requirements based on an employment relationship in the circumstances referred to in Art. 95 of the Public Procurement Law. The Ordering Party does not provide for the requirements referred to in Art. 96 of the Public Procurement Law. The Ordering Party does not provide for any requirements regarding the reservation that only Contractors referred to in Art. may apply for the contract. 94 of the Public Procurement Law. The Ordering Party does not envisage awarding contracts referred to in Art. 214 section 1 point 8 of the Public Procurement Law. The Ordering Party hereby informs that due to the specific nature of the subject of the order, it reserves the following: 1. a detailed description of the subject of the order included in Annex No. 1 to the SWZ Technical Specification is the key subject of the contract, 2. the key subject of the contract referred to in point 4.14.1, cannot be entrusted to subcontractors. The Ordering Party reserves that the Contractor will ensure the execution of the subject of the order in accordance with the above description of the subject of the order and the Contractors offer submitted according to the template constituting Annex No. 2 to the SWZ Offer form. The Ordering Party envisages the use of the so-called reverse procedure referred to in Art. 139 of the Public Procurement Law, i.e. the Ordering Party will first examine and evaluate the offers, and then subjectively qualify the Contractor whose offer was rated the highest in terms of the lack of grounds for exclusion and compliance with the conditions for participation in the procedure. The Ordering Party does not provide for reimbursement of the costs of participation in the procedure. All costs related to participation in the proceedings, preparation and submission of the offer are borne by the Contractor. The Ordering Party does not intend to convene a meeting of Contractors. The Ordering Party informs that in this ToR: the provisions of Art. 16a of the Public Procurement Law applies, does not express consent and does not specify the requirements referred to in Art. 16b of the Public Procurement Law.
