For the preparation of the project for the above-mentioned object, the Contracting Authority - Municipality of Iskar has concluded a contract with DMM-DESIGN EOOD with EIC: 200232698, as follows: - Contract No. D-OA-122 dated 04.06.2016 for design(a contract concluded on the basis of Article 92 of the Civil Code and on the basis of Decision No. 8/17.03.2016 for the opening of a public procurement procedure through negotiation without notice, with the subject: Project update:Improvement of a square space in the village of Staroseltsi, Iskar municipality, with a total value of BGN 4,166.67 without VAT and BGN 5,000.00 with VAT, respectively), including the above-mentioned object in its subject, Updatedthe initial general project for the object: Improvement of square space in the village of Staroseltsi, Iskar municipality. When updating the project, it is divided into two sub-objects: Ivy sub-object - Improvementsquare space, quarter 63 Staroseltsi village, Iskar municipality 2nd sub-project - Improvement of park space, quarter 36 Staroseltsi village, Iskar municipality with DMM-DESIGN EOOD, EIC: 200232698, Pleven region,Municipality of Pleven, city of Pleven 5800, Stoletov St. No. 4, e-mail: denism@abv.bg, phone: 0899944041, DENITSA TOPCHIEVA-DENEVA - MANAGER. In accordance with Art. 42, Para. 1 of the ZAPSP, the contractors/designers/ ofthe investment project have retained their copyright on the project. According to the provision of Art. 18, para. 2, item 9, in connection with Art. 3, para. 1, item 8 of the Copyright and Related Rights Act(ZAPSP) the projects, maps, schemes, plans and others related to the territorial organization are the subject of copyright and this right arises for its author with the creation of the relevant project,a plan, map or diagram. Taking advantage of the right regulated in Art. 42, para. 1 of the ZAPSP, the Executor of the work project has retained his copyright on the project - Pursuant to Art. 137, para. 1 of ZUT,for the lawful implementation of the construction works, there is a need to exercise authors supervision over all parts on the basis of Art. 162 para. 2 of the ZUT. Subject to the abovecircumstance of the existence of inalienable, guaranteed and protected by ZAPSP copyrights of DMM-DEZAYN EOOD, city of Pleven in relation to the investment work project, as well as in order to optimally andfast implementation of construction and assembly works for the object, it is necessary to impute to the Designer the obligation to perform the foreseen service of exercising authors supervision. To be fulfilledthe requirement of art. 162, para. 2 of the ZUT to determine the conditions and procedure for carrying out authors supervision during construction through a contract between the Contracting Authority and the Designer, it is necessary to choosecontractor to be carried out precisely according to the procedure provided for in art. 18, para. 1, item 8 of the Civil Code, in connection with Art. 79, para. 1, item 3, letter c of the Civil Code. The contractor, in his capacity as designer, will exercisethe authors supervision during construction, according to the approved project documentation and applicable regulations, through the designers of the individual parts of the project or authorized by thempersons, provided that the authorized persons have the necessary qualifications. There are intellectual property rights, as well as technical reasons contained in the requirement of Art. 162, para. 2 ofZUT, namely: The conditions and procedure for carrying out authors supervision during construction are determined by a contract between the Contracting Authority and the Designer. When conducting the procedure, the Contracting Authoritybenefits from the norm of Art. 65, para. 1, item 1 of PPZOP and does not apply art. 64, para. 2 and para. 3 of the PPZOP (without sending an invitation to participate in the procedure and without appointing a committee to conductprocedure), as the contract will be concluded in accordance with Art. 65, para. 2 of PPZOP, on the basis of Art. 79, para. 1, item 3, b. c from the PPA with DMM-DESIGN EOOD, city of Pleven. When signing the contractthe contractor submits, in addition to the documents under Art. 112, para. 1, item 2 of the Labor Code (including - Certificate from the bodies of the Executive Agency Main Labor Inspectorate for the circumstance under Art. 54, para.1, т. 6 от ЗОП) и декларация за липса на обстоятелствата по чл. 54, ал. 1, т. 7 от ЗОП.
