The requested ecopoints may only be offered by agencies recognized in accordance with the State Ordinance on the Recognition of Agencies for the Implementation, Maintenance and Long-Term Securing of Compensation Measures of May 31, 2021 (AgentAnerkVO). For the ecopoints offered, a written transfer of the compensation obligation in accordance with Section 2 of the AgentAnerkVO with a discharging effect to the recognized agency offering is mandatory and must be included in the standard price. The calculation of the eco points must be carried out in accordance with the ÖkokontoVO - State Ordinance on the Eco Account, the Establishment of the Compensation Directory and Standards for Replacement Measures (Eco Account and Compensation Directory Ordinance - ÖkokontoVO) - of the state of Schleswig-Holstein; the eco account does not yet have to be implemented or approved. If the ecopoints come from different ecoaccounts, a tabular allocation of the respective ecopoints to the ecoaccounts must be provided. With the ecopoints offered, a commitment is made to permanently compensate for the resulting interventions in the natural balance. After approval of the eco-accounts by the provider at the responsible UNB, the ecopoints must be reserved for the WNA NOK and be debited when the BImSchG approval is granted for the LZL Flemhude project. The contract holder must ensure that a limited personal easement is entered in the land register for the benefit of the user to permanently secure the ecopoints in the target state. The project sponsor acquires the right to use the ecopoints as compensation and at the same time is released from his compensation obligation to the extent mentioned. The contractor is responsible for implementing the measures and securing them. An LBP must be created for the approval process according to BImSchG. For this purpose, the boundaries of the eco-accounts from which points are offered must be made available as a shape file.
