This announcement serves to conclude contracts for special care in accordance with Section 140a SGBV for the implementation of ward replacement measures with the possibility of conclusion at any time as part of the so-called open house procedure for the period from (at the earliest) August 1st, 2026 to July 31st, 2028. This does not involve the awarding of public contracts within the meaning of Directive 2014/24/EU or Sections 97 ff GWB. Any suitable and interested company can become a contractual partner. According to the case law of the ECJ, such approval procedures are not necessarily subject to public procurement law, since no competition takes place due to the lack of a selection decision. The announcement serves as an invitation to conclude contracts for special provisions in accordance with Section 140a SGB V with conditions that apply equally to all contractual partners and are not subject to discretion, including the determination of prices. The contract is concluded by signing the contract documents (which can be requested from the contact point) and submitting the required declarations. There is no exclusivity for the conclusion of the contract. In the absence of a corresponding publication form, this contract notice will be used. The resulting conceptual specifications, such as the procedural designation “open procedure”, are solely due to the use of this announcement form. This does not entail any further meaning, in particular subjection to procurement regulations, unless they are required for legal reasons.
