This Term of Reference aims to point out the fundamentals of the proposed contracting and its feasibility for the acquisition of medicines, with the purpose of serving the health units under the management of this State Department of Health of Rio de Janeiro (SES/RJ), General Department of Socio-Educational Actions (DEGASE) and State Department of Penitentiary Administration (SEAP), in accordance with the conditions, quantities, requirements and estimates established in this instrument. It is worth noting that the Judicial Demand Assistance Advisory (ASSADJ) demonstrated interest in the medicines in this study to guarantee compliance with legal claims for the medicines in question. Despite being divisible, dividing the object into multiple tenders would likely result in the loss of economies of scale, reducing the ability to reduce the price through the dilution of the fixed costs of the operation. Considering that there is no prospect of an increase in competitiveness and an increase in the advantage of contracting due to installments, it is suggested that the object not be divided into installments. The object to be contracted is of a common nature in accordance with the sole paragraph of article 6, item XIII of Law No. 14,133/2021.
