Poland – Gaseous fuels – Kompleksowa dostawa paliwa gazowego dla Grupy Zakupowej w okresie od 01.01.2027 r. do 31.12.2028 r.

1. The subject of the order is a comprehensive supply of gaseous fuel in the form of high-methane natural gas (group E), consisting in the sale of gaseous fuel and ensuring the provision of its distribution service to installations located in the Ordering Party's facilities on the terms specified in the Act of April 10, 1997, Energy Law (consolidated text: Journal of Laws of 2026, item 43, as amended), as amended. hereinafter referred to as the "Energy Law Act" and in the implementing acts issued on its basis with specific quality standards. 2. The quality standards of gas fuel are described in the Energy Law, in the Regulation of the Minister of Economy of July 2, 2010 on detailed conditions for the operation of the gas system (consolidated text: Journal of Laws of 2025, item 1382, as amended), in the Regulation of the Minister of Energy of March 15, 2018 on detailed rules for shaping and calculating tariffs and settlements in the trade in gas fuels (consolidated text: Journal of Laws of 2021, item 280, as amended) and the applicable Tariff of the Distribution System Operator (Polska Spółka Gazownictwa Sp. z o.o.), hereinafter referred to as "DSO". 3. The proceedings covered gas fuel off-take points where customers are "subject to tariff protection", i.e. customers referred to in Art. 62b section 1 point 2 of the Energy Law and customers who are not covered by tariff protection. 4. In Annex No. 2 to the SWZ, the Ordering Party indicated in relation to which gas fuel consumption point the provisions of Art. 62b section 1 point 2 of the Energy Law and according to what percentage. Upon signing the contract with the Contractor whose offer is selected as the most advantageous, the Ordering Party (recipients) will submit appropriate "Declarations of gas fuel recipients" (under Article 62ba and/or Article 62bb of the Energy Law) according to the template established in the Regulation of the Minister of Climate and Environment of January 28, 2022 on templates of declarations submitted by gas fuel recipients on the intended use of gas fuel for the purpose of using specific solutions in connection with the situation on the gas market (consolidated text: Journal of Laws of 2025, item 1276). 5. A detailed description of the subject of the order as well as the requirements and rules for the execution of the order are specified in the draft provisions of the contract constituting Annex No. 3 to the SWZ together with a list of gas fuel consumption points constituting Annex No. 2 to the SWZ.
