1. The subject of the order is the supply of medicinal products. 2. The Ordering Party allows products other than medicinal products to be offered only in specific positions. In such a situation, it is permissible to offer foodstuffs for special medical purposes, medical devices, pharmaceutical raw materials and packaging. 3. A detailed description of the subject of the order, including information about the assortment, quantities and its requirements, was specified in the price form constituting Annex No. 2 to the SWZ, in which the Ordering Party requires the trade name of the drug and the GTIN number or other product identification code. 4. Detailed information indicating which of the offered products does not have to be a medicinal product is provided for each Part separately in Annex No. 2 to the ToR. 5. The Ordering Party allows products other than a medicinal product to be offered only in specific positions. In such a situation, it is permissible to offer foodstuffs for special medical purposes, medical devices, pharmaceutical raw materials and packaging. 6. The validity period of the offered subject of the order cannot be shorter than 6 months from the date of each delivery. 7. The offered subject of the order, which is a medicinal product, must be admitted to trading in accordance with the provisions of the Act of September 6, 2001 - Pharmaceutical Law (consolidated text: Journal of Laws of 2024, item 686). The requirement does not apply to parts where medicinal products are not required: 2, 4, 15, 17, 21, 22. 25, 26, 28 in the indicated positions. 8. If a medical device is offered, it must meet the requirements specified in the Medical Devices Act of April 7, 2022 (consolidated text: Journal of Laws of 2022, item 974, as amended). Such products are permitted in the indicated positions in parts 2, 4, 15, 17, 21, 22. 25, 26, 28. 9. If a food for special medical purposes is offered, they must meet the requirements of the Food and Nutrition Safety Act of August 25, 2006 (consolidated text: Journal of Laws of 2023, item 1448). Such products are permitted in the items indicated in Part 2, 24. 10. The subject of the order will be delivered at the Contractors expense, risk and transport to the hospital pharmacy - 1st floor, in the case of some infusion and irrigation fluids - a warehouse on the ground floor. 11. The Ordering Party allows the change of the form of the proposed preparations: - tablets to coated tablets or capsules or dragees and vice versa - vials to ampoules and vice versa. - vials and ampoules for pre-filled syringes 12. The Ordering Party specifies the following rules regarding changing the size of the offered packages: - it does not allow changing the size of immediate packages for liquid drug forms - replacing packages with larger ones for solid drug forms is only allowed if the offered product is packed in blisters - in the event of differences between the quantity of products listed in the SWZ and the quantity offered by the Contractor, when calculating the number of packages, their number should be rounded up to full packages.
